Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the crmtr software platform and related websites (collectively, the "Service") operated by the crmtr team ("we", "us"). By using the Service, creating an account, or subscribing to a paid plan, you agree to these Terms on behalf of yourself or the organization you represent.

2. Accounts and workspaces

The Service is multi-tenant. You are responsible for maintaining the confidentiality of credentials, for activity under your workspace, and for ensuring that users you invite comply with these Terms and your internal policies. You must provide accurate registration information and keep it up to date.

3. Subscriptions, billing, and refunds

Self-serve checkout starts a paid subscription processed through our payment provider (currently Stripe). We do not offer a renewable free trial through checkout. Fees, taxes, and currency are determined by the plan and checkout configuration in effect at purchase. You authorize us and our payment partners to charge your chosen payment method on the billing cycle you select. Where published, a 30-day money-back guarantee may apply subject to eligibility criteria in our billing terms (including fair use and abuse prevention). Downgrades, upgrades, and cancellations follow the billing and subscription terms published in our Billing & subscription termsand in-product notices where applicable.

4. Acceptable use

You agree not to misuse the Service, including by attempting to:

  • probe, scan, or test the vulnerability of any system without authorization;
  • overload, spam, or distribute malware;
  • use the Service to violate applicable law or third-party rights;
  • reverse engineer the Service except where mandatory law permits.

We may suspend or terminate access for material violations.

5. Customer data

You retain rights to data you submit to the Service. You grant us a limited license to host, process, and display that data solely to provide and improve the Service, as further described in our Privacy Policyand, where applicable, data processing terms.

6. AI-assisted features

Where the Service offers AI-assisted capabilities, outputs are assistive and may be incomplete or inaccurate. You remain responsible for decisions made using such outputs, especially in regulated or high-risk contexts.

7. Third-party services

The Service may integrate with third-party APIs, identity providers, or communication channels. Your use of those services may be subject to separate provider terms.

8. Warranties and disclaimer

Except where prohibited by law, the Service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Changes

We may update these Terms from time to time. We will post the revised version with an updated date. Material changes may be communicated by email or in-product notice where appropriate.

11. Governing law

Unless otherwise agreed in a written order form, these Terms are governed by the laws applicable to the contracting entity you do business with, without regard to conflict-of-law rules.
